Teen Hit by Train in Oshawa Dies

Oshawa Ontario - A 16-year-old boy hit by a train in Oshawa Monday afternoon has died.

Jacob Hicks was wearing headphones while crossing the tracks at Bloor St. E. and Wilson Rd. when he was struck by a CN train around 3 p.m.

"When trains come through Oshawa, they don't blow their whistles or bells because of a bylaw," Durham Regional Police Sgt. Nancy van Rooy said Tuesday.

"Even though he had ear buds in, there was no whistle to hear."

The bylaw, passed in 1982, says no such noises shall be emitted in order to not disturb citizens, "except to the extent that such ringing, blowing, or sounding is required by law or by the requirement of safety."

It goes on to say the rule should not prevent "any sound arising from the operation of any railway which operates under The Railway Act of Canada."

Jacob was airlifted to Sunnybrook hospital by ORNGE, the province's air ambulance service, with life-threatening injuries.

He died later Monday evening.

Van Rooy said the teen's death is under investigation.

Man Killed by Train Identified as Leduc High School Student

Leduc Alberta - A 19-year-old man struck and killed by a freight train in Leduc on Monday has been identified as Daniel Michael McPherson.

McPherson, a student at Leduc Composite High School, was walking south between the rails of the train tracks when he was struck by a southbound train near 50th Street and 41st Avenue shortly before 4 p.m. McPherson was wearing headphones at the time, RCMP said.

A spokesman for Canadian Pacific Railway said the train crew "did everything that was in their means", sounding the whistle and applying the emergency brake, but were unable to stop in time.

Const. Jodi Heidinger of Leduc RCMP said the tracks are in a grassy area between two fences. Walking and biking trails run parallel to the tracks, she said, adding the area around the tracks is open to the public.
